By installing, accessing, or using any Zyga Apps applications (the "Apps"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Apps.

Zyga Apps develops and publishes premium Shopify applications, including Visualize AI for augmented reality (AR) product visualization, and other innovative tools designed to help merchants grow their business and enhance customer experience.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts. By using our Apps, you represent and warrant that you meet these requirements.

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable license to use our Apps in accordance with these Terms and Shopify's Terms of Service.

4.2 Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble our Apps
• Use our Apps for illegal or unauthorized purposes
• Interfere with or disrupt our Apps' functionality
• Attempt to gain unauthorized access to our systems
• Use our Apps to violate any applicable laws or regulations

5. User Responsibilities

You are responsible for:

• Maintaining the security of your Shopify account
• Ensuring your product data is accurate and up-to-date
• Complying with all applicable laws and regulations
• Obtaining necessary permissions for camera access (where applicable)
• Informing customers about app functionality and data usage

6. Privacy and Data

Your use of our Apps is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our Apps, you consent to the collection and use of information as described in our Privacy Policy.

7. Fees and Payment

App fees, if any, will be clearly disclosed before installation. Payments are processed through Shopify's billing system. All fees are non-refundable unless otherwise specified.

8. Intellectual Property

Our Apps and their original content, features, and functionality are owned by Zyga Apps and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Disclaimers

OUR APPS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL ZYGA APPS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OUR APPS.

11. Indemnification

You agree to indemnify and hold harmless Zyga Apps from any claims, damages, or expenses arising from your use of our Apps or violation of these Terms.

12. Termination

We may terminate your access to our Apps at any time for violation of these Terms. You may terminate by uninstalling the Apps from your Shopify store.

13. Updates and Modifications

We reserve the right to modify our Apps and these Terms at any time. Continued use after modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes will be resolved through binding arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
